Earlier this year, the United States Citizenship and Immigration Services (“USCIS”) conducted a random selection process for the fiscal year (“FY”) on the 2024 H-1B cap registrations. During this initial process, USCIS selected certain electronic registrations that met the requirements for the H-1B visa, including beneficiaries eligible for the advanced degree exemption. Following the random selection, only those petitioners whose registrations were selected in the initial random selection were allowed to proceed with filing H-1B cap-subject petitions for FY 2024, which took place this past spring.
However, after the initial selection process, USCIS realized they needed to select additional registrations to meet the numerical allocations set for the FY 2024 H-1B cap. Accordingly, USCIS will conduct a second random selection process. They will re-evaluate previously submitted electronic registrations that were not initially selected and select additional registrations through a random selection process.
Once the second selection process is completed, USCIS will inform all prospective petitioners whose registrations were selected in this round. The selected petitioners’ USCIS accounts will be updated to provide a selection notice. This notice will contain details about the filing process, including specific instructions on when and where to file the H-1B cap-subject petition. Once selected, these petitioners will be eligible to file an H-1B cap-subject petition for the beneficiary named in the applicable selected registration.
